2.2 The design and content featured on the Website, including images, artwork, graphics, photography and text are copyrights and trademarks, and controlled or licensed by Kimia Skincare Limited. The site is protected by copyright and all worldwide rights, titles and interests are reserved.
2.3 We have taken great care in creating this Website and to the best of our knowledge have ensured that all the details, descriptions and pricing on all Goods are accurate. However, there may be occasions when some of the information featured on the Website may contain incomplete data, typographical errors or inaccuracies. We do not take any responsibility for inaccurate information and reserve the right to amend errors or to update product information at any time without prior notice.
2.4 We have also tried our best to display the Goods as accurately as possible on the Website. However, we cannot guarantee that your monitor’s display will accurately reflect either the colour or the size of the Goods.
- Make a contract with us.
3.1 When you place an order with us, you are making an offer to buy goods. We will send you an e-mail to confirm that we have received and accept your order, and that a contract has been made between us.
3.2 We will use our best efforts to keep the Website as up-to-date as possible. However, as the Goods are produced in small batches to ensure optimum quality, we cannot guarantee the availability of Goods as they appear on the Website. Additionally, some products shown on the Website may not be available to purchase through retail stores at which Kimia Skincare products are sold, and vice-versa.
3.3 Images of products on this website are for illustrative purposes only. Your goods may vary slightly from the image shown on the website.
3.4 Whilst we try to be as accurate as possible, all information provided is approximate and is provided in good faith.
3.5 This contract is covered by English law.
- How to place an order
4.1 You can use our website to place an order by selecting the product you wish to buy and adding it to your basket. Items you do not require can be removed from your basket at any time. If you prefer to order by telephone you can do so by calling 08445885346.
4.2 Carriage charges will be shown prior to you placing your order.
4.3 You will be required to pay for the goods in full at the time of ordering.
4.4 We use Worldpay secure payment facilities for online purchases. You can pay for your order by Visa, Mastercard, Delta/Connect. You may also pay via PayPal.
4.5 Promotional prices only apply during the period stated.
4.6 All prices quoted on our website are in UK pounds and include Value Added Tax at the current rate.
4.7 All transactions will be made in GBP sterling, and as the Buyer, You will be liable for any exchange rate charges made by your card provider.
4.8 All prices are as stated on the Website but Kimia Skincare reserves the right at any time to adjust prices without prior notice.
4.9 Overseas orders may be subject to local import duties and taxes for which you and not Kimia Skincare will be liable.
- Delivery & Carriage Charges
5.1 Goods will normally be dispatched from our warehouse within 7 working days and any estimated dispatch date is an estimate, which can change without notice.
5.2 We will normally deliver goods within 2-3 working days of dispatch.
5.3 Your order may arrive in more than one delivery.
5.4 We will deliver the goods to the premises you specify on your order. You must be at home to accept delivery of your order, which is normally between 9:00am and 6:00pm Monday-Friday. We will not accept responsibility for loss or damage if you instruct the delivery company to leave the goods unattended.
5.5 Disposal of packing materials is your responsibility.
5.6 After two failed delivery attempts (or if you are not at home for a delivery) the goods may be returned to us and we reserve the right to charge you an additional re-delivery charge.
5.7 Please check the goods on delivery – any items found to be missing or damaged should be notified or ourselves as soon as possible and in any event within 48 hours of receipt of the Goods.
5.8 If the goods are lost or damaged in transit, please let us know promptly.
5.9 Sometimes, for reasons beyond our control we may be prevented from delivering your goods as planned. These might include things such as accidents, breakdowns, fire, flood, storm, severe weather, acts of god, war, riot, civil commotion, malicious damage or the default of our suppliers. We will try to put things right as soon as possible however we can’t be responsible where this causes a delay or failure in delivering your goods.
- Cancellation and returns.
6.1 This policy does not apply to goods ordered by businesses which are exempt from the Distance Selling Regulations.
6.2 Our customers are important to us, so if after placing an order you change your mind, you are entitled to cancel that order within 24 hours of it being placed, subject to the Goods not having already left the Kimia Skincare premises.
6.3 You do not have to give any reason for cancellation. However, a brief explanation will help us to improve the service we offer to customers in the future.
6.4 To cancel an order, please e-mail, fax or write to us. We are unable to accept cancellations by phone.
6.5 If you are not completely happy with your purchase, please simply return the unused Goods to us in their original condition within 7 days of receipt. Unfortunately, we cannot make a refund for goods which have been opened, used, damaged by you after receipt or are not in a condition for resale. Otherwise, we can only accept returns if the Goods not fit for the purpose for which they were sold.
6.6 We will issue a refund (which will include the costs of the original delivery but not the cost of returning any Goods) on receipt of unused Goods in their original condition.
6.7 Refunds will only be made to the credit or debit card on which the purchase was made. Returns should be sent to the address outlined in section 1, in the original outer packaging or any other secure packaging.
6.8 Business customers, or customers exempt from the distance selling regulations may not cancel an order without our mutual agreement.
6.9 This cancellation policy does not affect your legal rights – for example, if goods are faulty or misdescribed.
- Product Guarantee
7.1 All our products conform to EU cosmetic legislation.
7.2 Our products are made in small batch sizes due to their natural nature and to ensure premium quality, inconsistencies and minor variations in colour and odour will occur from batch to batch, especially when using natural components. This is expected by the Company and is entirely normal.
7.3 You, as the Buyer, shall accept minor variations and shall only be entitled to refuse the whole or part of the goods if the variations render the Goods totally unfit for the purpose for which they were sold.
8.1 Kimia Skincare is unable to provide any warranties in relation to Goods over and above its statutory obligations to provide Goods of satisfactory quality in accordance with the Sale of Goods Act 1979 as amended by the Sale and Supply of Goods Act 1994.
8.2 This does not affect your statutory rights as a consumer.
8.3 No representation or warranty is given as to the suitability of the goods for any particular purpose and you shall satisfy yourself with this. Neither the Goods nor any information given in the Website are intended to, or claim to, diagnose, treat, alter, cure or prevent any skin disease or condition.
8.4 We will not be liable, in contract, tort (including, without limitation, negligence), pre-contract or other representations (other than fraudulent or negligent misrepresentations) or otherwise out of or in connection with these Terms and Conditions for any loss or damage, direct or consequential, arising from the use of any Goods; any economic losses (including without limitation loss of revenues, profits, contracts, business or anticipated savings); or any loss of goodwill or reputation; or any special or indirect losses suffered or incurred by that party arising out of or in connection with the provisions of any matter under the conditions.
8.5 Nothing in these Terms and Conditions shall exclude or limit our liability for death or personal injury resulting from our negligence or that of our employees.
- Law and Jurisdiction
This Legal Notice shall be governed by and construed in accordance with English law. Any dispute(s) arising in connection with this Legal Notice are subject to the exclusive jurisdiction of England and Wales.
